From: Alex Binder

To Whom It May Concern:

Pursuant to the Colorado Public Records Law, I hereby request the following records:

Any emails, letters, or any other records in written, electronic, or any other form, as defined by C.R.S. §§ 24-72-202(7) which were sent, received, or produced mentioning "costs" of "clean ups," "costs" for the services of the private contracted company "Environmental Hazmat Services," "inmate" labor used for "clean ups," "costs" to pay on duty "officers" for "clean ups," and/or "costs" for "storage" of items from "clean ups" during the time starting on October 1, 2018 until the date on which this request is processed.

If you deny this request for records in whole or in part, I ask that you provide a written statement explaining the reason for the denial that cites the legal authority that is the basis for the denial. If any of the requested records are in active use, in storage or otherwise unavailable at this time, I likewise request that you provide a statement informing me of the reason they are currently unavailable and a date and hour at which time the records will be available for inspection.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Alex B

From: Denver Department Of Public Works

Alex,

The staff member who could pull these records for me is out of the office until August 7.

When she returns, we estimate it will require 5 hours of staff time to pull the records. At the statutory rate of $33 per hour, with the first hour being free, the cost of retrieval and production would be $132.

If you’d still like to move forward with this request, please make a check in this amount payable to the Manager of Finance and mail or deliver to:

* Denver Public Works, 201 West Colfax Ave, Dept. 608, Denver, CO 80202

As far as your request for "inmate" labor used for "clean ups," "costs" to pay on duty "officers" for "clean ups," – Denver Public Works is not the custodian of those records. You will need to reach out to Denver Police and the Denver Sheriff’s Department.

Sincerely,
Heather Burke

From: Alex Binder

Hello Heather,

Thank you for your timely response. In accordance with C.R.S. §§ 24-72-205(4), if the only existing records are electronic, and therefore requiring computer output other than word processing, such as providing the electronic services and putting the records together, then I am further requesting that the fee be waived because the electronic services and products are to be used for a public purpose, since I am a journalist with a nonprofit media organization.

Thank you,
Alex B

From: Denver Department Of Public Works

Alex,

Denver Public Works does not waive fees. The fee is for finding, retrieving and reviewing the records so they can be produced.
Would you consider reducing the scope of your request?

Sincerely,
Heather

From: Alex Binder

Hi Heather,

Since DPW will not waive the fees, I will pay them. I prefer paying with a card through the Muckrock website. The scope of the request will remain the same.

Thank you,

Alex

From: Denver Department Of Public Works

Hi Alex,

How would that work? Paying through the Muckrock website?
Thanks,
Heather

From: Alex Binder

Hi Heather,

When I send the payment directly to Muckrock, they will then make a physical check out and mail it to you on my behalf.

I will be making the payment now.

Thank you,
Alex

From: Alex Binder

To Whom It May Concern:

Please find enclosed a check for $132.00 to satisfy the fee associated with the attached public records request.

Thank you.

From: Denver Department Of Public Works

Do you know when we should anticipate receiving the check?
Thanks,
Heather

From: Denver Department Of Public Works

Alex,

I’ll be out of the office on maternity leave starting next week.
Can you please provide a status when we should expect to receive your check?
Thanks,
Heather

From: Denver Department Of Public Works

Alex,

Ignore my previous email today – your check arrived this morning.
I’m going to send you separate emails with the documents, as there are a lot of files.

Please see documents attached responsive to your CORA request below for:

We got your check this morning, and I just sent you three separate emails with the documents as they are large files.
Let me know if you have issues receiving any of them…

From: Alex Binder

Hi Heather,

Just saw your e-mail that you received the check. I have received only two e-mails with attachments so far. Looks like mostly 2018 documents, and a few 2019. I'm sure the third e-mail includes more 2019 invoices?

Thanks

Alex

From: Denver Department Of Public Works

Yes, the third email is the 2019 invoices, so let me know if you don’t receive that one.
It was a lot of files - I can try separating it into two emails if you have issues getting it… just let me know.

From: Alex Binder

Hi,

I still have not received the third e-mail, if you could split it into two that would be great.

Thank you,

Alex

This is a follow up to a previous request:

Hi,

I still have not received the third e-mail, if you could split it into two that would be great.

Thank you,

Alex

Yes, the third email is the 2019 invoices, so let me know if you don’t receive that one.
It was a lot of files - I can try separating it into two emails if you have issues getting it… just let me know.

Hi Heather,

Just saw your e-mail that you received the check. I have received only two e-mails with attachments so far. Looks like mostly 2018 documents, and a few 2019. I'm sure the third e-mail includes more 2019 invoices?

Thanks

Alex

We got your check this morning, and I just sent you three separate emails with the documents as they are large files.
Let me know if you have issues receiving any of them…

Subject: Colorado Public Records Law Request: City of Denver costs of "clean ups" (Denver Department Of Public Works)

Sincerely,

Alex B

Hi Heather,

I will ask Muckrock if they have sent it. Is there someone else I can contact when you are on leave, so that this request is completed in a timely manner?

Thanks,

Alex

I just sent you several emails with the 2019 invoices attached.
If that doesn’t work, we may have to mail you a flash drive with those documents.

From: Alex Binder

I received them all.

Thank you.

Hi Heather,

I have a clarifying question. In the invoices it says the pay rate for the "Security Guard" (off-duty police officer) is $68, however at the bottom of each invoice where it says which officers were acting as the off-duty security guards, it says their pay rate is $50. Can you help me understand this discrepancy please?

Thank you,
Alex

From: Denver Department Of Public Works

I would suggest reaching out to Denver Police…. Thanks, Heather
