We have conducted a diligent search for records responsive to your request. We have located responsive records and are releasing them to you. Responsive documents for request items A and B are provided via this online portal. We have no responsive documents for request items C and D.

I allege violations of SFAC 67.21, 67.26, and 67.27.

We write to provide an update on the status of our consideration of your petitions. Since September 6, you have submitted five separate petitions to the Supervisor of Records and numerous other email communications concerning prior petitions. We have already responded to four other petitions you submitted in recent months.

Due to the volume of petitions and the complexity of the issues raised, we are invoking the rule of reason and will respond to your petitions within a reasonable time period with the goal of addressing each petition within 30 days of submission. As we recently explained in response to one of your complaints with the Sunshine Ordinance Task Force, we strive to respond to petitions within the 10-day period specified in Section 67.21(d), but we don’t view it as an absolute deadline. There are two separate issues here: one is the format itself, the other is the withholding of information in any format. No matter what format data is provided in, the City continues to withhold public information, including images, hyperlinks, formatting, and email addresses among other things. Taking your reasoning to its logical conclusion, a City politician wishing to hide mischief could take a Word document, save it as plain text .txt format, and withhold all potentially incriminating images, hyperlinks, and formatting by doing so, but not violate the Ordinance because this is merely "formatting."

You cite the CPRA's clauses, but the Ordinance and your voters have demanded more of the City than of other California jurisdictions. You ignore SFAC 67.21(l) regarding easily generated formats and SFAC 67.26 (" Information that is exempt from disclosure shall be masked, deleted or otherwise segregated in order that the nonexempt portion of a requested record may be released, and keyed by footnote or other clear reference to the appropriate justification for withholding required by Section 67.27 of this Article. "). There is no "reasonably segregated" limitation in the Ordinance -- everything non-exempt must be disclosed.

No response is requested to this note - but I will continue to pursue all of these cases, including tomorrow at SOTF, and in all other possible venues.

As you most likely know SOTF operations have been delayed over the last few months due to the Covid-19 emergency. The SOTF have started to conduct remote meetings via videoconference and are working to establish procedures to resume all operations including the processing of complaints.
While the Sunshine Ordinance requires that certain actions be taken within 45 days, the Covid-19 emergency has forced delays and immense new backlogs for complaint hearings. We write today to ask if you are willing to waive the 45 day rule for your complaint.
The SOTF intends to resume hearing complaints on a limited basis and complaints will be queued to be heard in the near future. We continue to work to address technical issues posed by remote meetings. We are aware of the time sensitivity of your records requests. We are following up on the email sent to you today regarding this request.  As you know, during the current public health emergency, the department is not required to provide copies of records within 10 days, plus possible 14-day extension, but must notify the requester whether the records exist. We have identified such records and have begun to release them to you. We will continue searching, reviewing and redacting records, and will produce responsive records as soon as reasonably possible. 

We estimate that we will be able to produce the remaining records approximately in early 2022.

I am writing to give you an update on the progress of this request. After your email regarding green-listed metadata fields, I contacted DT with your suggestions for additional fields that might be added. They have agreed with some of your suggestions and  have modified the green-listed fields. I will redo the emails that I previously released to you using this updated list. 

Also, DT has informed me that there is no metadata in the copies of emails contained in the Sent folder; therefore, we are unable to produce those records to you.

Based on that information, I now believe we will be able to produce all of the requested records by spring 2021.
