Dear Mr. Barbetta:

Thank you for submitting your Freedom of Information Act (FOIA) request to
the National Archives and Records Administration (NARA) via the
*FOIAOnline* website.
We received your request on July 15, 2021. Your request concerns a mail
truck robbery in Plymouth, MA in 1962, and related federal court trial
records circa November 1967, including grand jury minutes.

Our office uses the *FOIAonline* portal for FOIA and Privacy Act requests
for the National Archives and Records Administration's *operational *records
(records created by this agency). Because your *FOIAOnline *request is for
records that may be textual *archival *records (records created by or
originated in a different agency but that may have been transferred to the
legal custody of NARA), we are forwarding it to two of our components, *The
National Archives at Boston*, and our* Office of Research Services, Special
Access and FOIA *at our College Park, MD facility. *The National Archives
at Boston* holds records concerning federal agency operations in
Massachusetts, and permanent records of the federal courts in
Massachusetts. Please note that the FOIA does not apply to records of the
judicial branch of the federal government. Our *Special Access and FOIA*
office will search for any FBI files concerning the robbery that may have
been transferred to our College Park, MD facility.

Since *NARA Boston *and *Special Access and FOIA* do not process requests
through *FOIAOnline*, we removed your request from the *FOIAOnline* website.
Each component will assign your request a new tracking number, and respond
directly to you. In the future, if you need to follow up with these
components, please contact them at the addresses below, or electronically
via email (email is preferred).

Dear Mr. Jarrod Barbetta,

Thank you for your Freedom of Information Act request for records in the
custody of the National Archives and Records Administration. Due to the
COVID-19 pandemic, we are not able to process FOIA requests according to
our normal procedures. We will conduct a search of our index of accessioned
FBI Case Files for the documents pertaining to the Plymouth Mail Truck
Robbery and the individuals indicted in this event, and have assigned your
request the temporary tracking number *RF-896*. When we resume normal
operations, we will log requests into our system in the order they were
received. At that time, we will provide you with a new FOIA tracking number
and a more substantive response. We apologize for this inconvenience and
appreciate your understanding and patience.

Sincerely,

Hi Jarrod,

The FOIA office forwarded your two requests to the National Archives at
Boston. As they said, judicial records are open to the public and we can
get you copies for a fee or you can come in and work through the case file.

I located a potential range of cases where US v. Patricia Diaferio, John
Kelley, Thomas Richards ( 67-0216) could be in our storage caves in Lenexa.
Unfortunately, the finding aid doesn't list each case, so I won't know
until someone can look at the box. I've put the request in and should hear
back next week. Facilities around the country are coming back online, but I
don't know their status and staffing issues may delay this request to check
for the case and to have it copied.

In case you haven't seen it, the seven-page docket for this case is
available online:https://catalog.archives.gov/id/146290724. Jump to image
#37 for the beginning.

You're correct that any material in the court case files is open. There's
another series of Significant Case Files from the U.S. Attorney that I'm
going explore next week. I may not find anything, but it's worth a look.
I'll let you know when I hear back from Lenexa, but please let me know if
you have any follow-up questions.

Best,
Nathaniel

Hi Jarrod,

This is in response to your second question. Could you share where you're
seeing these dates and individual names? Also, is there a particular Howie
Carr article that you can point to? Citations like this would really help
us narrow down where to look.

We are staffed to provide research support services, not research itself.
If you need help, a list is available on our website.
<https://www.archives.gov/research/hire-help> Our online catalog is also
another good place to start to narrow your search down:

The Informant Records of one, George William Agiasottellis during the
period of December 1962 and January 1963, as reported and recorded by
Postal Inspector Earl Wheeler.

Context: These records were previously produced to the public At a hearing
on October 23rd, 1967 and previously at a Grand Jury hearing in June of
that year, where it was confirmed by Postal Inspector Raymond J. Dunne,
U.S. Attorney Paul Markham, Assistant U.S. Attorney, Postal Inspectors,
Edward Lee, John Collins and M.V. Sailor, that one George William
Agiasottellis was temporarily employed as an informant for the Postal
Inspectors for the months of December 1962 and January 1963 with a
compensation of $75. Mr. Agiasottellis’ “handler” was Postal Inspector Earl
Wheeler.

Mr. Agiasottellis became a fugitive for jumping bail, and said to have been
murdered, thereby negating any possible ‘reprisals’ nearly 60 years later.
In addition, records pursuant to the investigation by the Postal
Inspectors, have been previously dispatched to one Howard Carr Boston
Herald Reporter and Author, in which portions have been published as recent
as 2014, therefore further negating the argument of the case files being no
longer in existence.

The requested documents will be made available to the general public, and
this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform
me of the total charges in advance of fulfilling my request. I would prefer
the request filled electronically, by e-mail attachment if available or
CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I
look forward to receiving your response to this request within 20 business
days, as the statute requires.

Sincerely,

Jarrod M. Barbetta

From: Jarrod M. Barbetta

Good afternoon Nathaniel,

The Howie Carr portion of my question is pertaining to Mr. Carrs book, “Plug Uglies: a scrapbook of Boston Organized Crime” published in 2014 (ISBN 10: 0986037273) (ISBN 13: 9780986037276) published by Frances LLC.

The Names and Dates referenced come from transcripts previously obtained of the following court case: Cr. No. 67-216-W dated: October 13th, 23rd, 27th & November 6th through November 10th & November 13th through November 17th, 1967

I hope this helps.

Dear MuckRock.com,

You have already received several responses. For the court records part of
your question, FOIA does not apply to archival judicial records. I
previously linked you to the online dockets for the US v. Patricia
Diaferio, John Kelley, Thomas Richards ( case #67-0216). We checked the
boxes for the case file and there are no transcripts or grand jury
minutes or testimony, but there was a three-page indictment.

We have a $20 mail fee to cover this request if you want copies (1-25
pages). You can call me to pay by credit card. You can also send a check
to: National Archives at Boston, 380 Trapelo Road, Waltham, MA 02452.
Please make checks payable to the National Archives Trust Fund.

interest, we are closing your request administratively. This concludes the
processing of your request.

If you are not satisfied with our action on this request, you have the
right to file an administrative appeal within ninety (90) calendar days
from the date of this letter. Appeals must be in writing and may be
delivered by regular U.S. mail or by email. By filing an appeal, you
preserve your rights under the Freedom of Information Act and present the
deciding agency with an opportunity to review your request and reconsider
its decision. If you submit your appeal by regular mail, it should be
addressed to the Deputy Archivist of the United States (ND), National
Archives and Records Administration, 8601 Adelphi Road, Room 4200, College
